Terms: 10% down payment shall be deposited from the buyer to the Robberts & Kirkman Law Office Trust Account at the end of the auction with the remainder of the purchase price due at closing. The Seller shall provide a current abstract at their expense. Home sells “as is, where is”. Sale is not contingent on Buyer’s financing or any other contingencies. Pursuant to Iowa Code 455B.172 the sellers are exempt from providing a Time of Transfer Certificate due to the property being sold out of an estate. All items offered in this auction are sold "AS IS", WHERE IS" with no warranties or guarantees expressed or implied. It is the buyer's responsibility to inspect the real estate. Your bid confirms that you have done so, and you are accepting the real estate in it's "as is" condition. Your bid constitutes an agreement to purchase the real estate as described at the final bid price. No statement anywhere, whether oral or written, shall be deemed such a guarantee, warranty or representation. At Hoenig Auctions, we encourage thorough examination prior to bidding. It is the sole responsibility of the bidder to inspect, assess each item condition, authenticity, age, value or other factors and place bids accordingly. If in the future a site clean up is required, it shall be the responsibility of the buyer. Payment Terms
- For Winning Bidders, all purchase agreements and contracts for purchase shall be signed by all parties immediately following the conclusion of the auction.
- Buyers shall be prepared to make the appropriate down payment for purchase of real estate immediately following the conclusion of the auction.
  - Accepted payment methods include:
    - ACH Debit Payments, Wire Transfers, Cash, Certified and Personal Checks are all acceptable forms of payment.
    - The currency for all purchases shall be billed and paid in US Dollars.
Bidder Registration:
- To register for and participate in our auctions, you must create a FREE account using a valid email, user name and password. A valid credit card is also required for bidding registration to ensure bidder validity. While it is free to register to bid, we do have a verification process of a dollar amount that is credit/debit to your card for verification of identity. Hoenig Auctions reserves the right to approve or reject any bidder at our discretion.
  - to register you must be at least 18 years of age.
  - Registered bidders accept all responsibility to pay the purchase price, including buyer’s premiums, convenience fees and applicable sales tax.

BIDS:
- Auctioneer reserves the right to reject any bid. If an offering has a reserve, the auctioneer reserves the right to bid up to the reserve amount on behalf of the seller. The highest bidder acknowledged by the auctioneer will be the buyer. In the event of a tied bid or dispute between bidders, Auctioneer has final discretion as to who is the winning bidder.

Hoenig Auctions shall not be held accountable for any inability to submit bids resulting from internet disruptions, items closing ahead of schedule, or errors made by individuals. Should a technical problem arise as an auction is concluding, we reserve the right to close, reopen and extend the auction duration to ensure a fair and complete bidding opportunity for all involved.

All sales at Hoenig Auctions are governed by the laws of the State of Iowa. Should any disputes arise from these auctions, they must be resolved within the jurisdiction of Iowa.
